Terms of Service

These Terms of Service ("Terms") govern your use of the Trackker platform ("Service") provided by Mannan Technologies Private Limited("Trackker", "we", "us", or "our"), a company incorporated under the Companies Act, 2013 with its registered office at 1st Floor, Plot No 142, St No.5, Blk-B, Balbir Vihar, New Delhi, Delhi 110086, India.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

Trackker is a web-based analytics and attribution platform that helps marketers track website visitor activity, attribute conversions to marketing campaigns, and make data-driven decisions. The Service is provided as a software-as-a-service (SaaS) product accessible at app.trackker.co.

2. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must notify us immediately if you suspect unauthorized access to your account.
  • You must be at least 18 years old to use the Service.
  • One person or entity may not maintain more than one account.

3. Subscription Plans and Payment

Plans: We offer Starter, Pro, and Enterprise plans with different features and limits. Details of each plan are available on our pricing page.

Billing: Subscriptions are billed monthly in Indian Rupees (INR). Payments are processed securely through Razorpay Payment Solutions Private Limited.

Taxes: All prices displayed on our website are exclusive of applicable Goods and Services Tax (GST) unless stated otherwise. GST at the prevailing rate (currently 18% for SaaS services) will be charged in addition to the subscription fee where applicable. Tax invoices will be provided for all payments.

Auto-Renewal: Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. It is your responsibility to cancel before the renewal date to avoid being charged. You will receive a reminder email before each renewal.

Late Payment: If payment fails, we may suspend your account access until payment is resolved. Data will be retained for 30 days after suspension, after which it may be permanently deleted.

4. Refund Policy

We offer a 30-day no-questions-asked refund for first-time subscribers. Details are available in our Refund Policy. By subscribing, you acknowledge that you have read and agree to the refund terms stated therein.

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal or unauthorized purpose under Indian or international law
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or its infrastructure
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to collect data in violation of the Information Technology Act, 2000 or any applicable privacy laws
  • Resell, redistribute, or sublicense the Service without our written permission
  • Send spam or unsolicited communications through or using the Service
  • Artificially inflate traffic counts or manipulate usage metrics

6. Data Ownership

Your Data: You retain full ownership of your data at all times. The tracking data collected through your use of the Service belongs to you. We process this data on your behalf as a data processor.

Our Rights: We may use aggregated, anonymized data to improve the Service. This data cannot be linked back to you or your customers.

Data Export: You can export your data at any time through our API or CSV export feature.

7. Service Availability

We aim to maintain high uptime, but we do not guarantee uninterrupted or error-free operation of the Service. Scheduled maintenance will be communicated in advance when possible. We are not liable for downtime caused by factors outside our control.

8. Usage Limits

Each plan has specific limits on traffic, projects, and data retention. If you exceed your plan limits, we may throttle or pause data collection until the next billing cycle or until you upgrade your plan. You will be notified before any data collection is paused.

9. Intellectual Property

The Service, including its design, code, features, and documentation, is owned by Mannan Technologies Private Limited and is protected under the Copyright Act, 1957 and other applicable Indian intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service according to your subscription plan. This license does not include the right to copy, modify, or distribute any part of the Service.

10. Account Suspension

We reserve the right to suspend or terminate accounts that misuse the Service, attempt to manipulate tracking data, or violate fair usage policies. We will provide notice where possible, but reserve the right to act immediately in cases of fraud, abuse, or security threats.

11. Termination

By You: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period.

By Us: We may suspend or terminate your account if you violate these Terms, fail to pay, or if we determine that your use poses a risk to the Service or other users. We will provide reasonable notice before termination where possible.

After Termination: Upon termination, your access to the Service will be revoked. You can request a data export before termination. Data will be deleted within 30 days after account closure.

12. No Warranties

The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or completely accurate at all times. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. No Guaranteed Results

Trackker is an analytics and attribution tool. We do not guarantee specific marketing outcomes, revenue results, or return on ad spend (ROAS). The effectiveness of your marketing campaigns depends on many factors outside our control. Our Service provides data and insights to help you make informed decisions, but the results you achieve are your own responsibility.

14. Limitation of Liability

To the maximum extent permitted by applicable Indian law, Trackker and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total aggregate liability for any claim arising from or related to the Service shall not exceed the total amount you paid us in the 12 months preceding the claim.

15. Indemnification

You agree to indemnify, defend, and hold Trackker and its officers, directors, employees, and agents harmless from any claims, damages, losses, liabilities, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights or applicable laws.

16. Force Majeure

We are not liable for any failure or delay in performing our obligations under these Terms due to events beyond our reasonable control, including but not limited to natural disasters, internet outages, server failures by third-party providers, government actions, pandemics, strikes, or acts of terrorism.

17. Dispute Resolution

Amicable Resolution: In the event of any dispute arising out of or in connection with these Terms, the parties shall first attempt to resolve the dispute amicably through good-faith negotiation within 30 days of written notice.

Arbitration: If the dispute is not resolved amicably, it shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted by a sole arbitrator appointed by mutual consent of the parties. The seat and venue of arbitration shall be New Delhi, India. The language of arbitration shall be English.

18. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Subject to the arbitration clause above, the courts of New Delhi, India shall have exclusive jurisdiction over any legal proceedings arising from or related to these Terms.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, and any other policies referenced herein, constitute the entire agreement between you and Trackker regarding the use of the Service.

21. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by email or through a notice on our website at least 15 days before the changes take effect. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
